Heavy overnight rain washed out the fourth day of play in Yorkshire's match against Sussex, which ended in a draw.
Umpires Jeremy Lloyds and Steve Garratt made their decision an hour before play was due to start at Scarborough.
Sussex cricket boss Mark Robinson had queried whether Yorkshire would declare on their 133-7 to deny the visitors a possible third bowling point.
Garrett said: "It was a hypothetical situation but had it occurred, we would have to mention it in our report."
