The US Olympic Committee has confirmed that Torri Edwards and Calvin Harrison have both been included in the team for Athens despite facing doping charges.
World 100 metres champion Edwards and Olympic 4x400m relay gold medallist Harrison have both tested positive for banned stimulants.
"Those two athletes are on the list of athletes we submitted," said USOC spokesman Darryl Seibel.
Under US law, those awaiting hearings cannot be banned from the Games.
The USOC has indicated that the official track and field line-up - to be announced on Thursday - is the same as the provisional team already announced by USA Track and Field.
But the International Olympic Committee has said it will give countries until mid-August to make substitutions for exceptional circumstances.
That would include athletes found guilty of doping violations.
Edwards is a medal contender for the 100m, 200m and the 4x100m relay.
But she faces a two-year ban after testing positive for the banned stimulant nikethamide at a meeting in Martinique in April.
She appeared before an arbitration hearing panel in southern California on Monday and is awaiting its verdict.
Harrison has been selected as a member of the 4x400m relay squad after finishing fifth in the 400m at the US trials.
He tested positive for the stimulant modafinil at the 2003 US championships and faces a two-year ban as it was his second stimulant positive.
His hearing is due to take place on Monday.
