Derbyshire remain in a strong position to beat the champions after reducing Surrey to 208-6, a deficit of 177.
Lee Goddard and Graham Wagg extended their seventh-wicket stand to 181 in 66 overs, Derbyshire's final four wickets adding 261 for a total of 385.
Goddard, in probably his final match for the county, drove to short extra for 91 and Wagg made a career-best 94 before pushing Ian Salisbury to slip.
Surrey lost Jon Batty first ball and Mark Butcher ricked his neck on 51.
Butcher should have been caught at slip having made only a single but Steve Stubbings spilled the chance.
The skipper then added 94 in 17 overs with Scott Newman and progressed smoothly to 51 containing eight fours until hurting his neck playing forward to Steffan Jones, and after lengthy treatment was forced to leave the field.
