Surrey captain Mark Butcher made an unbeaten 85 to set Leicestershire an unlikely victory target of 414.
Butcher's second fifty of the game came on day three as Surrey consolidated on their first innings lead of 126.
Scott Newman hit seven fours to reach fifty from 72 balls, and brought up a century stand with Jonathan Batty.
Ali Brown and Azhar Mahmood fell first ball in a mini collapse but Butcher held firm, with the Foxes losing Darren Robinson in reaching 74-1 at stumps.
Brown was bowled by David Masters, who then claimed a third wicket in eight balls when Rikki Clarke edged behind.
Butcher was well supported by Tim Murtagh and was able to call the innings to a halt after a century partnership.
