X Factor reject Gamu Nhengu's family has been given a chance to try and convince a court to let them stay in the UK.
The singer's family was told by the government in October that they had to leave the country because their permission to stay here had run out.
But now they've been allowed to appeal against the decision. Their case will be heard by a court in late November.
Gamu's from Zimbabwe, Africa, but lives in Scotland with her mum and brothers.
The 18-year-old was one of the early favourites to win this year's series of The X Factor.
She made it to the judges' houses stage but Cheryl Cole didn't pick her for the live finals.
