Nanny guilty of assaulting baby

A nanny has been convicted of grievous assault on a two-and-a-half-month-old boy which left him with brain injuries and a broken arm.

Jasmin Schmidt, 32, of Primrose Hill, north London, injured the baby while she was left with him at nights in September 2002, the Old Bailey heard.

Schmidt babysat while the parents from North Yorkshire, who ran a designer shop, attended London Fashion Week.

The German national denied two charges of grievous bodily harm with intent.

During the trial the court heard the boy, who did not suffer any permanent damage because of his injuries, was left in Schmidt's care at night between 13 and 16 September.

Sally Howes QC, prosecuting, told the court: "Miss Schmidt assaulted the baby.

"That assault resulted in serious injuries - bleeding and injury to the brain as a result of having been shaken, and also causing a broken right arm."

'Whimpering sound'

She said the morning after the second night, Schmidt told the mother the boy had been restless and "appeared angry" and she had attempted to "swaddle him in a blanket but he would not settle".

"She had placed him on his side and tapped him on the back quite hard in order to get him to be quiet", Miss Howe added.

After the babysitter left, the boy's mother checked on him and noticed the area around the baby's eyes were blue and he had dried milk around his mouth.

He made a "whimpering sound" and was "very pale and cold to the touch".

The mother rang Schmidt and found her unhelpful and defensive, the court heard.

The mother felt instinctively something was wrong and took the baby to hospital.

Following the verdict recorder Jeremy Gold QC said: "The fact that I have renewed your bail should not be taken as any indication by you of what the possible sentence is likely to be.

"All options are open including in your case the strong possibility of a period of imprisonment."

Schmidt will be sentenced on 8 September.
