Actor Sizemore 'fails drug test'

Tom Sizemore Actor Tom Sizemore faces jail after prosecutors in Los Angeles accused him of failing a drugs test.

The Saving Private Ryan star allegedly tested positive for drugs last month. Earlier this week he was thrown out of a drug treatment programme.

This prompted Superior Court Judge T K Herman to call a hearing to assess whether he had violated his probation.

The 44-year-old has been on probation since being convicted in October 2004 of possessing methamphetamine.

It was revoked after he faked a drug test in May, only to be reinstated in October by a judge who praised him for his progress in his fight against drug addiction.

Domestic violence

If the actor is found to have violated his probation a second time he could be sent to prison for 16 months.

Sizemore is accused of getting himself ejected from his treatment programme for arguing with another person.

But he told the judge on Thursday that he was just talking with the unnamed man, whom he said would testify on his behalf when the hearing resumes on Tuesday.

The actor was convicted in 2003 of domestic violence involving his ex-girlfriend Heidi Fleiss.

He has since appealed against his conviction, arguing that a photo of Ms Fleiss with facial bruises may have been fabricated.
