Drunk drove with girl in backseat

Perth Sheriff Court
The court heard that Mudie was already banned when he was caught

A disqualified driver who was caught nearly four times the alcohol limit with a four-year-old in the back has been jailed for three months.

Melville Mudie was serving a two year ban when he drove the girl and three adults in Perth on 25 August.

Mudie, 46, from Perth, was arrested and released on bail, but weeks later he was caught drunk at the wheel again.

At Perth Sheriff Court, he was also banned from driving for eight years and placed on probation for two years.

He was also ordered to attend a drink drive project and get alcohol counselling.

'Extremely serious'

Mudie admitted driving in Dunkeld Road, in Perth, on 25 August with an alcohol reading of 130 micrograms, compared to the legal limit of 35 micrograms.

He also admitted driving while disqualified and having no insurance at the time.

He further admitted that he drank and drove again near his home on 4 October.

He was stopped after a paramedic saw him driving erratically and noticed he was covered in blood. He needed nine stitches for self-inflicted wounds.

On that occasion the reading was 90 micrograms, and he again admitted being banned and having no insurance.

Sheriff Michael Fletcher told him: "These are two offences of drink driving with high readings. The lower of the two is still well over twice the limit.

"On both occasions you were already disqualified from driving and that makes it extremely serious.

"You were stopped for drink driving and within a very short time indeed you were back on the road. The court cannot tolerate that. I cannot deal with that any other way than by a custodial sentence."
