On-the-run rapist sentence delay

A man who raped a 16-year-old schoolgirl after escaping from an open prison has had his sentencing delayed.

Robert Foye, who was originally jailed for the attempted murder of a police officer, had been due to be sentenced at the High Court in Edinburgh.

Judge Lady Smith told the court that a psychiatrist needed more time to complete his report on Foye.

Foye, 28, absconded from Castle Huntly open jail before carrying out the rape in Cumbernauld in August last year.

He had previously run away, but was sent back to the open jail, near Dundee, despite there being a "high risk" of him re-offending.

Judge Lady Smith told Foye: "These reports are, of their nature, complex.

"They are highly detailed, highly professional pieces of work."

She said it was important the doctor should have as much time as he needed.

The Scottish Prison Service has already said it is tightening the rules in the wake of the case.
