Man jailed for male rape attempt

A man who attempted to rape another man at a house in East Dunbartonshire has been jailed for 30 months.

The High Court in Glasgow heard how 34-year-old Derek Barrett's victim ran a mile naked to a friend's house after the sexual assault in January 2007.

The 25-year-old man had to fight him off after waking up naked in bed with Barrett on top of him.

Barrett was found guilty of attempted rape. He was placed on the sex offenders' register.

The court heard how Barrett and his victim had been drinking at a social event with others on the night of the attack.

It was clear from the evidence the events had a profound effect on the complainer.

His victim, who is gay, had fallen asleep fully clothed in a bed but later woke up naked with Barrett touching him.

The man said Barrett attempted to have sex with him and became more aggressive when asked to stop.

The victim said he had to fight off Barrett before running out of the house naked and going to a friend's house for help.

When Barrett, from Bishopbriggs, was questioned by police, he said his victim had made up a story.

But DNA analysis proved there was sexual contact between the two men.

Passing sentence, temporary judge Mark Stewart QC told Barrett: "It was clear from the evidence the events had a profound effect on the complainer.

"This was a matter which caused him the most severe distress."
