Edgar Kudzhoyan behaved in a "reprehensible fashion"

A 23-year-old man who raped a teenage girl at a party in Glasgow has been jailed for two and a half years. Edgar Kudzhoyan, a trained cage fighter, attacked the 17-year-old in a bedroom at a flat in the Knightswood area of the city in 2005. He was also found guilty of a charge relating to a "happy slap" assault on another teenage girl at the same party. Four others were previously sentenced to community service and probation for their parts in the second incident. At a previous trial at the High Court in Glasgow, Kudzhoyan was convicted of rape and acting in a lewd and libidinous manner. The court heard that Kudzhoyan joined other teenagers at the party at the flat on 11 June 2005. The rape victim, now 21, told how she remembered getting "very drunk" that night. She said she could not move as muscle as Kudzhoyan , who is trained in several martial arts, was on top having sex with her. Prosecutor Andrew Miller asked: "How did you feel that this was happening?" She said: "I felt really dirty."

The court was told that Kudzhoyan had also that evening been involved in a "degrading" assault on an unconscious 14 year-old girl which was filmed on mobile phone cameras. The victim, now 18, watched the graphic 20-second clip in court and said she was "shocked" as she had no idea at the time what had gone on. She was indecently assaulted and had the word "bitch" scrawled across her forehead. A number of young men, including a topless Kudzhoyan, could be seen in the footage. Five other party-goers walked free from court in 2007 after they had also been arrested in connection with the filmed attack. Community service Tom Sier admitted indecently assaulting the girl while Dean Bowman confessed to writing on her forehead. Sier who has since been acquitted of an unrelated rape allegation was sentenced to community service while Bowman was put on probation. Mohammed Khan and Daniel Halliday also received community service after they admitted storing footage of the attack on their phones. Dimitry Fescenko was cleared of any involvement in the incident after trial. Sentencing Kudzhoyan, judge Lord Turnbull said the Russian had lost his "moral framework" at the party and behaved in a "reprehensible fashion". He told Kudzhoyan, considered by social workers to be at high risk of re-offending, that the rape sentence could be limited to two and a half years. He sentenced him to six months for the other charge with both terms to run concurrently. He was also placed on the sex offenders register.
