Teacher had sex with pupil
The case was heard at Glasgow Sheriff Court
A woman has told a court how she reported her teacher husband for having underage sex with a 14-year-old girl pupil.
William Kyle, 55, of Croftfoot in Glasgow admitted to having had sexual intercourse with the child, who cannot be named because of her age. Glasgow Sheriff Court heard on Tuesday that Kyle became close to the pupil during a school trip to Holland. Their friendship grew over a number of months and involved secret rendezvous at night.
The teacher and his pupil were discovered by Mrs Kyle on the first day they had had sex. Depute fiscal Laura Taggart told the court Kyle's wife returned home one afternoon as the couple lay in bed. She walked into the room and caught a glimpse of the naked girl disappearing into a cupboard. Shocked at her husband's behaviour, Mrs Kyle immediately informed his school. Deferred sentence Kyle confessed in an interview to police the next day to having had sexual intercourse with the 14-year-old. He said it was the first time they had had intercourse. He pleaded guilty to the charge at a previous court appearance. And on Tuesday the facts of the case were read out for the first time. Sheriff Charles McFarlane deferred sentence for reports until 28 August.
Ms Taggart said that in September 1999 the girl pupil told her teacher she had feelings for him. She added: "He said that he had feelings for her and she suggested they meet up outwith school. "He agreed to that and they began meeting in secret at night when they went for drives in Mr Kyle's car." In summer, 2000 the teacher and the pupil confessed their love for each other after returning from a school trip to Disneyland Paris, when Kyle had also taken his son. 'Initially reluctant' The court heard when Kyle was called before the head teacher to explain the e-mail he had received from his pupil. Kyle said the girl was infatuated. Shortly after the e-mail incident, the pupil's father spotted his daughter in a car talking to the teacher. Kyle went to see her father to assure him there was nothing untoward going on and agreed to the parents' suggestion that they should not spend so much time together. Ms Taggart told the court that during a lunchtime drive on February 5, 2001, the girl suggested they take the rest of the day off school. She told the court: "Mr Kyle was initially reluctant but after some persuasion he agreed to the complainer's suggestion. "Mr Kyle telephoned the school saying that he had sustained an injury to his back due to a fall and said he would not return to work that day. 'Kissing and cuddling' "Both of them made their way back to Mr Kyle's home. Once inside, they began kissing and cuddling. "The complainer took hold of the accused and led him to the bedroom. "Once inside the bedroom he said: 'what have you got in mind?' She said: 'I will show you.' "She started to get undressed and Mr Kyle started to get undressed as well." The court was told sexual intercourse took place with the complainer's consent. When Mrs Kyle found the pair she asked the girl whether she was over 16, the girl replied that she was actually over 17. |
