Parton fan loses eviction battle

A Country and Western fan who plagued neighbours by playing Dolly Parton songs around the clock is to be evicted from her home, council officials say.

Diane Duffin, 36, appeared at Leeds County Court on Thursday and failed to overturn an order to have her evicted.

She was found to have repeatedly and persistently ignored warnings from the council to stop the music.

She told the judge her children played the music but she will now be evicted on Monday, unless she goes beforehand.

Last October she was handed an anti-social behaviour injunction (Asbi) along with an eviction notice, suspended for 12 months, which meant she could lose her home if she failed to comply with the conditions of her tenancy.

'Nine to Five'

The court heard that her neighbour had moved out and their house in Heights Drive, Leeds, had stood empty ever since.

Neighbours told the earlier hearing the mother of four repeatedly played Dolly Parton's Nine to Five track.

One neighbour had complained that on one day alone the Tammy Wynette track D.I.V.O.R.C.E was played 20 times from Miss Duffin's home.

Councillor Steve Smith, executive board member for environmental services said: "Unwelcome noise nuisance can make people's lives a misery and we will tackle anyone who shows wilful disregard for others in this way."
