Timeshare fraudster John "Goldfinger" Palmer, has won a rehearing of his application to move to an open prison.
Palmer was told at the High Court that his case to be made a low-escape risk category D prisoner was to be reconsidered by prison authorities.
Mr Justice Collins described a Home Office decision that Palmer was too high a security risk to be sent to an open prison as "fatally flawed".
The Bath fraudster conned 16,000 people in a timeshare scam.
He has recently been ordered to pay more than £3m to his victims, who paid up to £30m but never received their share of a holiday home.
Speaking on Monday, in the High Court in London, Mr Justice Collins said: "It seems to me there must be a fresh consideration which must take into account all the material Mr Palmer has raised in these
proceedings."
