A mobile phone company is refusing to move a mast despite demands from a resident and the local council.
T-Mobile put up the temporary 72ft (22m) mast in Eastwood, Nottinghamshire in December, when building work blocked the signal from an existing mast.
Despite an order from Broxtowe Borough Council, T-Mobile said it is not yet prepared to move the mast.
The firm has appealed the order and the case has gone to the Planning Inspectorate for consideration.
Resident Malcolm Fletcher said he was shocked when the mast appeared at the bottom of his garden overnight.
Service problems
"Apart from the fact that the first thing we see in the morning is that mast and it is there all day long there is obviously the thoughts of what worries we may have with the children's health.
"Nobody has proven to us that there is no problems come from these masts - I have yet to see it."
He added: "I think everything should be in its place and the place of that mast is certainly not at the bottom of any residential garden, let alone mine."
T-Mobile said it was still not in a position to move services back to its permanent mast and if they were forced to move the temporary facility many people will be denied service.
