A fish merchant has been fined after an unsympathetic judge heard about noisy early-morning sing-songs in a hot tub.

Charles Roach, 35, lost his appeal at Hull Crown Court against fines by JPs for breaching noise abatement orders when friends sang in his garden tub.

Judge Tom Cracknell told him: "It is bad enough people singing Yellow Submarine in a hot tub at 9pm, let alone at nine in the morning."

He was fined £1,500 and his stereo kit - worth £1,200 - was confiscated.

Prosecutor Charlotte Baines, for Hull City Council, said Mr Roach was originally fined by Hull Magistrates' Court after breaching a noise abatement order imposed last summer to stop neighbours having to listen to his hot tub antics.

But she said council officials had been called out three more times to listen over the fence as he partied at 7.25am, 8.15am and 8.30am, mainly with male voices singing.

Defence barrister Nigel Clive said he accepted his singing and music had been too loud at times but the complaints had come from just one person and many of his neighbours had supported him with good character references to the court.

Dismissing the appeal, the judge said: "Those that live in close proximity have to live in a way that they don't offend their neighbours."
