Brick death charge is dismissed

A manslaughter charge against a woman, who had a row with a man over a parking space, has been dismissed.

Bernard Gilbert, 79, died of a heart attack after a brick was thrown into his home in Derby on 28 January 2007.

The judge at Nottingham Crown Court ordered the jury to find Zoe Forbes, 26, of Ripley, Derbys, not guilty due to insufficient evidence.

Her husband Mark, 40, and his brother Steven, 22, from South Normanton, both deny manslaughter charges.

The three defendants have admitted conspiracy to damage property.

The court heard earlier Mr Gilbert had been verbally abusive to Mrs Forbes during a row over a parking space in Asda four days before the attack.

The jury was then told Mr Forbes plotted a revenge attack.

A medical expert had also said the brick attack on Mr Gilbert's home was of "extreme relevance" to his death.

Giving evidence, Mr Forbes said he had no intention of causing harm to Mr Gilbert and that text messages sent to his wife talking about the pensioner's death were "bravado".

The case continues.
