Army lawyers are deciding whether to mount a prosecution

British soldiers in Iraq have been investigated over allegations of the "unlawful possession" of weapons, the Ministry of Defence has said.

The Royal Military Police inquiry centred on troops with the 3rd Battalion, Yorkshire Regiment.

The Army Prosecuting Authority (APA) is examining the case and has yet to decide if any action is necessary.

Ten soldiers were initially investigated over claims that weapons were illegally taken out of Iraq.

Following that investigation, one case was passed to the APA.

A spokeswoman said: "The Royal Military Police carried out an investigation involving the unlawful possession of small arms.

"The APA is currently considering the case. We cannot comment further until the outcome of the case."

The battalion completed a tour of duty in Iraq last year and is based in Warminster, Wiltshire.
