The Real Photography Showcase: Terms and Conditions

1. WHO MAY ENTER

The Real Cities Photography Showcase (the "Showcase") organised by InterContinental Hotels Group PLC ("ICH") and BBC World News Limited ("BBCW") (together the "Organisers") is open to everyone eighteen (18) years of age or more at the time of entry. Employees of the Organisers and each of their subsidiaries and affiliated companies, and immediate family members of such employees (defined for the purpose of these rules as husband, wife, mother, father, sister, brother, son, daughter, or persons residing in the same household of such employees) are not eligible. Professional photographers may not enter. Professional photographers are defined for this purpose as individuals who derive more than 50% of their annual gross income from the sale of photographs and/or provision of photographic services. The Organisers reserve the right to verify the eligibility of entrants and check their identity.

2. TERM

Entries for the Showcase can be submitted from 24 September 2010. The last date for entry will be 7 November 2010.

3. ENTRY REQUIREMENTS

Entrants may submit no more than one photograph that capture the spirit of a particular city (the "Photographs"). Entries must comply with the following requirements:

- The Photograph must have been taken within five (5) years prior to the beginning of the Showcase term.

- The Photograph, in its entirety, must be a single work of original material taken by the Showcase entrant. By entering the Showcase, the entrant represents, acknowledges and warrants that the submitted Photograph is an original work created solely by the entrant and that no other party has any right, title, claim or interest in the Photograph; nor does the Photograph substantially take from or colourably imitate the work of someone else.

- Obscene, provocative, or otherwise objectionable content will not be considered, and such determination is solely at the discretion of the Sponsor.

- Photographs that have already won any prize or distinction in another competition will not be eligible for entry. Any Photographs that have been published or sold commercially (whether directly or via an agency intermediary) will also not be eligible.

- You must be prepared to provide Organisers with the original high resolution image as recorded by the camera with no manipulation applied (e.g., *DNG, *NEF, *JPG, *CR2, *CRW). Failure to provide such a file on request may result in disqualification.

- You may crop the Photograph before submission. The actual representation of a natural form, image or phenomenon must be maintained. Altering the Photograph in any way using Photoshop techniques, multiple exposures, compositing is not permitted.

4. HOW TO ENTER

You must submit your entry digitally:

- Images should be saved at a suggested 8" x 10" vertical or 10" x 8" horizontal .jpg files; and must be a minimum of 72 DPI.

- Images must be saved as .jpg files at the highest possible quality setting (12 or Max in Photoshop).

- The file name/label must carry the name of the entrant and the key subject (e.g., JSmith, NewYork.jpg).

- Photographs must be submitted by e mail to therealphotos@bbc.com. Entries must be accompanied by the entrants' name, address, contact telephone numbers and a written description of not more than 100 words that explains why the entrants think the picture shows the real essence of the city photographed.

5. ENTRANTS LICENCES AND WAIVERS

Each entrant grants to the Organisers (and their licensees, designees and affiliated companies) (collectively, the "Authorized Parties") a non-exclusive, royalty-free license through the entire world and for the duration of intellectual property rights pertaining thereto, to use and reproduce, in whole or in part, without any number limitation, in any form, by any mean or process, or any medium, whether now known or hereafter existing, the Photographs and the accompanying descriptions for editorial, commercial, advertising, promotional, publicity or trade purposes, including commercially using and exploiting it to the fullest extent possible including modifying it for operational and editorial reasons for instance by cropping and/or adjusting the exposure, contrast, brightness or colour.. Each winner further acknowledges that any Authorized Party may use a name credit in connection with such use, in any media now or hereafter known. No Authorized Party will be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation.

All entrants hereby irrevocably and unconditionally waive in favour of the Authorized Parties all moral rights in any "Footage" to which he or she is, or may at any time in the future be, entitled.

6. THIRD PARTY CLEARANCES

Photographs which contain readily recognisable images of people, visible trade marks or other copyright works will only be considered eligible in the sole discretion of the Organisers and if an appropriate release form is provided by the entrant should the Sponsor so request.

7. JUDGING

The judge will evaluate the entries based on the following criteria:

(1) Extent to which the Photographs captures the spirit of the Real Ciry

(2) Exhibition of what makes the place unique

(3) Composition

(4) Creativity

(5) Clarity and technical quality

The judge will be an expert in the field of photography. The judge will select three Photographs to appear in a short form programme appearing on BBC World News about the Real Cities Showcase. These Photographs, together with other Photographs chosen by the Organisers may also be shown on the Real Cities website and other BBC World News programmes and promotional material created by the Organisers.

The names and country of the entrants may be published alongside their Photographs if published by the Organisers. By submitting the Photographs, all the entrants consent to such publication in any circumstances in which the Photographs are reproduced by the Authorized Parties in accordance with the Entrants Licences.

The Organisers' and/or judge's decision on all matters (including the eligibility of entrants and entries) relating to the Showcase is final. No correspondence will be entered into concerning the Showcase's judging and organisation.

The three selected entrants' names will be available online by 14th November 2010 at www.bbc.com/thereal.

8. LIABILITY

All entries are sent at the entrant's risk. By participating, entrants agree to release, discharge and hold harmless Organisers and their partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Showcase or any Showcase-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

9. USE OF PERSONAL INFORMATION

The BBC may need to contact you for administrative or verification purposes in relation to your contribution, or in relation to particular projects. For full details of when and how we may contact you please see the BBC's Privacy Policy.

10. RIGHT TO CANCEL OR SUSPEND SHOWCASE

If for any reason the Showcase is not capable of running as planned Organisers reserve the right, at their sole discretion, to cancel, terminate, modify, or suspend the Showcase and/or to disqualify any individual(s) who tamper with the entry process. If Organisers elect to cancel or terminate the Showcase, for the avoidance of doubt the Entrants licences will still subsist.

11. AGREEMENT

Submission of an entry to the Showcase automatically constitutes the entrant's acceptance of all the Terms and Conditions set forth in the above rules. Entrants not complying in full with the above Terms and Conditions will be disqualified. Entries that are incomplete, or damaged will be disqualified. Odds of winning depend on number and calibre of entries received.
