Actress Lindsay Lohan has been caught on video drinking, two months after checking out of a rehabilitation clinic for an alcohol problem.

The star was seen drinking champagne from a bottle at a New Year's Eve party in Capri, Italy.

"Lindsay immediately stopped, called her sponsor, and got herself back on track," Lohan's lawyer Blair Berk said.

The 21-year-old was in Capri to receive a contribution to cinema award at its Hollywood International Film Festival.

'No magic cure'

But the star's lawyer has insisted the incident was just a minor slip.

"There is no magic cure here. Unfortunately, Lindsay has to share her 'one day at a time' with the entire world."

The actress admitted to having a drink and drugs problem in August 2007 and spent time receiving treatment.

She spent 84 minutes of a one-day term in jail last November after admitting to drink driving and possession of cocaine.

The star was also put on three years' probation and ordered to complete an 18 month alcohol education program.
