A US judge has allowed actor Dom DeLuise to continue legal action against his former daughter-in-law after she sued him for $2m ($1.05m).

The actor is suing Brigitte DeLuise, her lawyer, Steven Zelig, and his firm, saying their legal action caused him emotional and financial distress.

In a Los Angeles court, Mr Zelig argued unsuccessfully that there was no evidence to support the claim.

Brigitte DeLuise's action alleges an attempt to cut her off financially.

This followed her August 2003 divorce from David DeLuise, she claims.

Mr Zelig also argued in the Superior Court on Friday that Dom DeLuise's legal action violated state law aimed at preventing the silencing of critics by burdening them with legal costs.

But Judge Judith Chirlin rejected the motion to throw out the claim.

"I find that there were sufficient grounds for the lawsuit to have been filed," she said.

"There is a likelihood of it prevailing on the merits."

Dom DeLuise has appeared in films including Blazing Saddles, The Muppet Movie and The Cannonball Run.
